The Framers of our Constitution separated the powers of government between three different branches. Of those branches, the judicial was designed to be the least able to infringe on the rights of the people. Today, however, it seems the judiciary is not only the ablest to infringe on our rights, but the most likely to do so. What happens when the courts interfere with the people’s exercise of their power through their elected officials? What happens when judges can simply refuse to assent to laws based on their opinions, not the law? If the ability of the American people to exercise their power through elected officials can be overruled by the opinion of a single judge, are we still a republic? Or have we allowed ourselves to devolve into an oligarchy of men and women in black robes who rule from benches?
