? False Confessions and Forensic Interviewing

by | Apr 19, 2019 |

Print Friendly, PDF & Email

Police-induced false confessions are among the leading causes of wrongful convictions and since the late 1980s, six studies alone have documented approximately 250 interrogation-induced false confessions. Police-induced false confessions occur primarily in the more serious cases, especially homicides and other high-profile felonies. More than 80 percent of the 125 false confessions documented by Professors Steve Drizin and Richard Leo occurred in homicide cases.

In fact, false confessions make for the leading cause of wrongful convictions in homicide cases. Learn why people falsely confess to serious crimes they never committed and get some important tips on forensic interviewing from two of the nation’s top forensic interviewers on this fascinating episode of “A Thread of Evidence.”

I enjoyed your podcast on false confessions. During my law enforcement career, I have witnessed two confessions later determined to be false. The first occurred when I was interviewing a suspect by myself and the second occurred as I monitored someone else interviewing a suspect that I had previously interviewed. Both cases involved missing children in Texas. Minimization was used as an interrogation tactic in both interviews. Both suspects were in the vulnerable population of those who might falsely confess, i.e., both were adult males with cognitive impairments—one slight, one more apparent. In both cases, I understood the confessions might have been unreliable because of my training in false confessions. After subsequent attempts to verify details of both confessions, each were determined to be highly improbable and investigative resources were directed elsewhere. Both cases are now solved so we know the confessions were false. In a perfect world, false confessions do not survive the scrutiny of thorough investigations. However, through the work of the Innocence Project, we know people have falsely confessed and neither the investigators who obtained the confessions, their co-workers, their managers, the prosecutors, nor anyone else influential in these investigations realized that something was seriously wrong. Ineffective counsel appears to be another common element in these cases. While this does not excuse a faulty investigation, this is another “safety-net” failure in the process that allows false confessions to become wrongful convictions. Hopefully, as more and more law enforcement officers, prosecutors, and defense attorneys become educated on the earmarks of false confessions, the need to fully record suspect interviews to look for these earmarks, and the need to corroborate confessions, the notion that false confessions can potentially lead to wrongful convictions will become a thing of the past.

Weaponizing Victimhood for Fun & Profit

Weaponizing Victimhood for Fun & Profit

How can a sense of victimhood be used to radicalize a populace into embracing genocidal policies? Dr. Jordan Petersen explains how those who frame themselves as victims use their status as justification for rejecting right and wrong. Why would people choose to identify as a victim? For many, the siren song of victimhood is irresistible because it…

Iran’s Brewing Christian Volcano

Iran’s Brewing Christian Volcano

Christianity is flourishing, and the implications are potentially very profound and world-shattering. What is happening in Iran today, is an incredible repeat performance of how Christianity spread under Roman Pagan rule. The consequences for the world will be enormous because the collapse of Khomeini’s regime would not only…

Governments Have Lost the War Against the Virus

Governments Have Lost the War Against the Virus

The various mandates being forced upon us don’t just violate our freedom of conscience and personal autonomy, they cross a number of ethical and moral lines as well. When an idea is so good that it must be made mandatory, it’s not really a good idea at all. This is especially true when it comes to “dealing with the unvaccinated” as if they’re causing harm…

More Boots on the Ground Means More Cash for the Military-Industrial Complex

David McGrath does not mince words when describing Lloyd Austin, Mark Milly, and what is called the “Military-Industrial Complex.” Austin and Milley, he said, are not bright generals and have no real connection to wars other than making money. The more boots on the ground for these generals, the more money they make. The military veteran, who was stationed in Kabul, said…

Covid Extortion by Bureaucrat Bullies

Today, there are multiple entities using their power, legitimate or otherwise, to bully the American people into becoming test subjects for experimental medical products. COVID Q & A with Dr. Peter McCullough, #3

We have had no side effects that we are aware of from the vaccine. Does this mean we are free from future side-effects? Should we forego any boosters? Did the vaccine destroy our natural immunity? Pushing Back Against Abortion and Corrupt Politicians

Pushing Back Against Abortion and Corrupt Politicians

Irene Armendariz-Jackson describes abortion as the “ugly part of man that we could possibly think of dismembering a baby in the mother’s womb.” The issue of abortion is the reason she is involved in politics. William Rodriguez Morrison is running for mayor of Los Angeles to get the homeless off the streets, and fix the city’s ailing infrastructure…

The Taliban and the War on Terror

The Taliban and the War on Terror

The lasting question that we will be asking for years, if not decades, is what does the future of the war on terror look like? The withdrawal of US troops from Afghanistan soil was completely motivated by a political calculus to coincide with the twentieth anniversary of 9/11. Ironically, the reason we committed the blood and treasure was precisely the same reason why we left…

Special Doctors are Heroes Risking all They Have for Their Country

At a time of crisis and failure of our public health agencies, America needs our strongest voices in medicine to discuss and debate the scientific literature and rapidly evolving information coming out on the pandemic. Better Off To Abstain From the Media Than Drink Their Kool-Aid

It’s very common to hear media talking heads going back and forth over issues like vaccine hesitancy. They just can’t seem to fathom why the public won’t take their word on such life or death matters. Konstantin Kisin has a pretty compelling explanation for the media types who are asking themselves: Why won’t they believe us?

California Recall has Major Implications for Republicans

California Recall has Major Implications for Republicans

A recall would not only trigger a new power balance in the state but in DC as well. For example, if a Republican is selected to replace Newsom in the recall, Democrat Senator Diane Feinstein, who has been rumored to be retiring soon, could see a Republican choose her replacement. This would flip the senate in DC and give Republicans the majority…
