Mike Pence was a good vice president to President Donald Trump. He served his country well right up to the point of him fulfilling the most important part of being vice president. On January 6, 2021, he presided over the certification of the presidential electoral votes. A role given to the vice president in the US Constitution. It was in this role he choked and became a derelict.

Under the 12th Amendment and the Electoral Act of 1887, during the certification of electoral votes, if a Representative objects to the certification of a state’s votes, and is joined by a Senator, the president of the Senate, which happened to be Pence, must send those votes back to the state. The state can then decide to keep the vote as is or reseat and certify new electorates. This decision lies squarely on the state and not the vice president. It does not say this is an act or an attempt to overturn the vote of the people or give the VP the power to change an election. Unfortunately, Pence and others have misread this all-important function of the vice president.

Had Pence fulfilled his Constitutional duty, the acrimony existing over the election of 2020 wouldn’t be. To be clear, this is not to say the certification would have gone in Trump’s favor, but it would have fulfilled the role of the vice president.
