What was the first grievance listed in the Declaration of Independence? “[The King] has refused his Assent to Laws, the most wholesome and necessary for the public good.” Can you think of a better way to describe how our judges work today? No law can go into effect in America today if a judge doesn’t like it. All it takes is one judge to disagree with a law, or even just find it questionable, and what happens? They slap an injunction on those who are tasked with enforcing that law, and it waits in limbo until the court grants their assent. We’ve even gotten into the habit of referring to the opinions of these judges as “rulings” and “settled law,” yet they are neither. Judges do not rule, and neither do they make law. So what happens when America as a whole⏤lives under the delusion that judges rule and make law? We turn them from disinterested arbiters of the facts into oligarchs who rule from their benches. The question is, can the American people fix the mess we’ve created?
