The Law of War is defined as that part of international law that governs the conduct of armed hostilities. Included in this lesson are the principles underlying the Law of War, as well as the classification of persons that may be found on the battlefield. The Law of War is often referred to as the law of armed conflict (LOAC). The two terms are interchangeable. 

The Rules of Engagement (ROE) are those directives that delineate the circumstances and limitations under which United States (US) forces will initiate and continue combat engagement. 

The Defense Department tells its officers, “It is imperative that we, as leaders, not only know what the Law of War is, but we also have the ability to conceptualize these principles and train our Marines to the same standards.”

Tragically, the historical records show the truth of the proverb that The road to hell is paved with good intentions.” 

This means that one is naive and acts in good faith with no altruistic objective. It merely seems like the proper or even sensible thing to do. In this scenario, the act, regardless of its virtue, leads the actor to unintended negative consequences.

The rules were set in place primarily to protect civilians and prevent friendly fire incidents among warring nations that followed these rules. The rules had good intentions, but over time, they became so convoluted, confusing, and outdated that many US lives were lost in the process of abiding by them.

In the simplest form, the ROE dictated when and how one could fight the enemy. Because of the different nations, branches, locations, and weapon systems that were involved in the war, different rules applied to different people, which could change again depending on one’s location and change once more a few days later.

Unfortunately, because most modern warfare is asymmetrical – asymmetric warfare is the term given to describe a type of war between belligerents whose relative military power differs significantly, or whose strategy or tactics differ significantly – conducted against terrorists and or mercenaries of all kinds, who never follow these rules – therefore these ROE become a hindrance to conventional armies but actually assist terrorists, allowing them extra opportunities to strike and or escape.

The modern terrorists, especially the Muslim Jihadists, have neither understanding of nor respect for International Law nor care for the loss of lives, whether combatant or civilian – not even of their own – because terror is, after all, their prime objective, and, therefore, slaughtering civilians is precisely what they are invariably aiming for.

While US, European and Israeli soldiers attempt to protect civilians – their own and the enemy’s – and reduce collateral damage as much as possible. Muslim terrorists, in particular, use their own citizens, schools, mosques, and other civilian structures to conduct war. Their primary purpose is visual propaganda to show the unsuspecting and mostly uncomprehending media and world opinion that they, the terrorists, are the victims. Because of the lopsided and insane ROE, America unnecessarily lost thousands of precious lives in Somalia, Afghanistan, Iraq, and Benghazi (under Obama and Hillary Clinton).

These ROE are usually put forth by back-seated military personnel and or lawyers – not officers and soldiers on the ground – who make up directives that prohibit the men and women doing the fighting from taking instant and appropriate decisions and initiatives to do the right thing at any moment of time – unless orders from higher echelons are received – therefore, allowing the initiative to be lost and adversely endangering the lives of US soldiers.

Thousands, if not tens of thousands, of American lives, were lost or maimed over the years in Viet Nam, Somalia, Afghanistan, Iraq, and other places, not only because of these rules but also for the total failure of all leaders in the West to comprehend the mindset of their adversaries.

The best examples of asymmetrical warfare are between Israel and Hamas in Gaza or Israel and the Ayatollahs in Syria or Israel and Hezbollah in Lebanon.

In the case of Hamas in Gaza, for example, the Muslim terrorists – as defined by Arabs and the West – hide their rockets, artillery, and military assets among the houses of their citizens as well as in mosques, hospitals, and schools. 

The West – like the UN – in the meantime, utterly and completely ignores these facts and knowingly supplies these Gaza terrorists with hundreds of millions of dollars to allow them to arm themselves with the latest military hardware; to dig attack tunnels, to teach their children to hate and commit acts of terror.

Hezbollah in Lebanon does precisely the same by putting its military assets among civilian areas. The sickening part of all of this is the fact that the UN – which monitors the south of Lebanon – and Western militaries also completely ignore these illegal activities, thus making them complicit with the terrorists.

In the case of Syria, the Iranians attempt to smuggle military hardware and technologies to both Hamas in Gaza and Hezbollah in Lebanon by using civilian aircraft and civil airports to do so, forcing Israel to retaliate with pinpoint accuracy these targets to minimize collateral damage; which does not always succeed.

The Western military, intelligence, and security services should NOT be restrained by archaic, out-of-date ROE and should be allowed many latitudes to outsmart and outgun our enemies with minimum limitations on how our military on the ground should deal with these; otherwise, unrestricted terrorists.

It is, therefore, beyond comprehension and beneath contempt why Western leaders aid and abet Islamic terror – which is also directed at their citizens – by knowingly ignoring these facts and realities.

Sooner than later, all Western countries will suffer horrendous terror attacks because, as Kuffar (Infidels, None Muslims), they too will not be spared Islamic mass murder in the long run.
